1. Who we are

m7nk (the "Service") is operated by brinka labs ("we", "us", "our"). By creating an account or using the Service you ("the user") agree to these Terms.

2. Acceptance

By continued use of the Service you agree to be bound by these Terms. If you do not agree, do not use the Service. You confirm you are of legal age in your jurisdiction or have authority to bind the organization you represent.

3. The Service

m7nk is an online football trivia game. We offer a free tier and a paid "Pro" subscription that unlocks additional features.

4. Acceptable use

You agree not to misuse the Service. You must not: (a) use the Service unlawfully or fraudulently; (b) send spam or unsolicited content; (c) infringe intellectual property rights; (d) interfere with the security of the Service, including via malware, probing, scraping, or automated clients; (e) attempt to manipulate scores, leaderboards, or question pools.

5. Account & credentials

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information and keep it up to date.

6. Intellectual property

brinka labs retains all rights, title, and interest in the Service, including software, content, branding, and trivia content. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial use within your chosen plan. You may not reverse engineer, resell, or redistribute the Service.

7. Payments, subscriptions & taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refunds are governed by the Paddle Checkout Buyer Terms and our Refund Policy.

Pro is a monthly auto-renewing subscription. You may cancel at any time from your account; access continues until the end of the current billing period.

8. Service level

We do our best to keep the Service available but do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

9. Suspension & termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, pose a security or fraud risk, or repeatedly violate our policies. On termination, your right to use the Service ends and we may delete your data after a reasonable period.

10. Liability

To the maximum extent permitted by law, our aggregate liability to you is limited to the fees you paid in the twelve (12) months before the claim. We are not liable for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where prohibited by law.

11. Indemnity

You agree to indemnify brinka labs against claims arising from your content, your unlawful use of the Service, or your violation of these Terms.

12. Governing law

These Terms are governed by the laws applicable at brinka labs' principal place of business, without regard to conflict of law rules. Disputes are subject to the exclusive jurisdiction of the competent courts in that jurisdiction.

13. Changes

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance.
